A long time ago I wrote a Blog and I referenced a quote that applies to everything we are seeing and hearing from politicians, pundits, and media today. It goes like this:
Facts Don’t Care About Your Feelings – Ben Shapiro
It doesn’t matter if you “like” Ben or even if you agree with his opinions on things. He’s right about that statement. People tend to ignore facts if they don’t align with the way they think life should go. Let me give you some simple examples that apply to MY life.
I want my youngest roommate to receive a full scholarship to college …. But.. the FACTS don’t care what I want. His grades don’t warrant a full scholarship no matter how much I might wish for him to get it.
I want a house overlooking Cinnamon Bay on St. John. The FACT is my bank account doesn’t contain the funds for that wish to become a reality so once again… my feelings or desires are pretty irrelevant.
Now, for how that statement effects our country today….. Ruth Bader Ginsburg died and as a result there is an open seat on the Supreme Court that needs to be filled. Whether you want the seat to be held until next year when we possibly have a new President is irrelevant. Whether you think Merrick Garland should be wearing a black robe right now but isn’t because of Mitch McConnell is also irrelevant.
I know it’s a tough pill to swallow. The Supreme Court is a very powerful branch of Government and people are passionate about the butts that sit in those big wooden chairs, but the US Constitution is pretty clear on the rules about those butts. It doesn’t leave any room for your feelings or desires. It doesn’t allow for changes because of your outrage. The document doesn’t have an “A” side and a “B” side depending on which party controls the branches of government. It contains FACTS with zero room for your feelings.
I think Ruth Bader Ginsburg described the situation we are in and what should be done about it perfectly when asked about the Senate role in the process:

Ruth made a dying wish that her seat be held until a new President is elected. That’s really a lovely sentiment but we are not a monarchy. We don’t bequeth our seats in Government to people and we don’t honor dying wishes over the clearly stated laws of the US Constitution. The ones shouting that Donald Trump won’t accept the election results and leave office in January are the same ones shouting that we need to leave a SCOTUS seat open because RBG thought the seat belonged to HER instead of to the citizens of this country.
Let me just cut right to the chase of this entire chaotic issue…… The Democrats are still dumbfounded that the candidate they selected did not win the 2016 election. And to make things even worse, the man they call an incompetent buffoon is going to shape the direction of our country for decades because he is going to put his 3rd Justice on the Supreme Court. It’s a nightmare that has become reality for them.
I’ll reach back into the archives and find a quote from a previous leader that should help people come to grips with the impending placement of a female Supreme Court Justice. Shortly after Barack Obama’s inauguration in 2009, he told the GOP:
Elections have consequences,” and in case there was any doubt, “I won”
In 2016 Donald Trump became the 45th President of the US and the US Senate was controlled by Republicans. In 2018, the American people were given an opportunity to reshape Congress and they chose to make the Democrats the majority party in the House of Representatives and add numbers to the Republican controlled Senate. All seats in DC are either elected or appointed and the American people control who sits in them. That’s how our government works whether you like it or not.
To argue that a SCOTUS vacancy be held until we determine if Joe Biden will be the new White House resident is ridiculous. If your argument is but…. “Merrick”…. give it up. That ship has sailed and as Obama said, Elections do indeed have consequences.
Here’s some FACTS that you need to know about SCOTUS nominations and confirmations.
- 29 times a SCOTUS vacancy occurred during an Election year
- All 29 times, the President nominated someone to fill the seat
- 19 of those times the President and Senate were controlled by the same party resulting in 17 Confirmations
- 10 of those times the President & Senate were controlled by opposite parties and ONLY 2 of those resulted in a Confirmation. 8 of them were NOT Confirmed.
If Merrick Garland had been put forward for a vote in the Senate, he would NOT have been confirmed so the whole argument that Justice Gorsuch is “sitting in his seat” is WRONG.
As far as timing…. because heads are exploding about the “Rush Job” that the Senate and President seem to be pushing… That is also RIDICULOUS! Here are some FACTS about that:
- Since 1900, a total of 61 justices have been nominated and confirmed to the Supreme Court
- 43 of those were confirmed in UNDER 46 days
- Ruth Bader Ginsburg was confirmed in 42 days
- John Roberts was confirmed in 23 days
I really think if Brett Kavenaugh had been vetted and treated with a modicum of decency by the Democrats on the Judiciary Committee, then possibly the Republican leadership would be hesitant to proceed in filling the vacant seat. BUT…..Democrats treated that man horribly and accused him of being a sexual predator and gang rapist with flimsy evidence from one woman with no memory of important details.
It was a political hit job plain and simple and it was appalling. It’s pretty easy to understand why Republicans this time around have circled the wagons and said we WILL confirm the next nominee come hell or high water! The Democrats have only themselves to blame for this newfound determination by the Republicans.
The vacancy on the Supreme Court needs to be filled. There is very little doubt that the November 3rd election will end up being brought to the court for rulings on the legitimacy of votes in many states. It’s unfortunate that States have changed voting rules and timeframes but they have and those issues more than likely will need to be settled by the highest court in our country. If you are concerned that the soon to be 9 justices on the court will rule based on political views, I must remind you that not too long ago Chief Justice John Roberts assured us that they do not “play politics” on his court. The media agreed with his opinion then. They said President Trump was sowing division by implying that the court was political. Watch as the media changes their analysis on this in the coming weeks. It’s predictable and it’s disgusting!
Nancy Pelosi can load all of the quivers she wants into her arrow but the House of Representatives has ZERO role in the confirmation process of SCOTUS. Chuck Schumer can make all the threats he wants about “using every means necessary to stop this from occurring” but he has no viable means to stop it because he is in the minority. If this whole issue makes your stomach turn and your anger rise… I strongly encourage you to VOTE.
Until then…. don’t let your feelings get in the way of the FACTS and the facts are….. we WILL have a new Supreme Court Justice in the coming weeks.
